These terms shall constitute the agreement between Panasa Web Solutions Private Limited a Company with registered corporate office at 405, Parimala Sadan, 17-132/A, Kamala nagar, Hyderabad, INDIA - 500060  providing a service called ID Monitor, and you, “YOU” the end user of this service.

Acceptance of Terms:

If YOU agree to be bound by the terms of this agreement, YOU should say Yes on the "I accept the terms of use and privacy policy" box on the sign-up form. If YOU do not agree to be bound by the terms of this agreement, YOU will not be able to proceed with the Online guards ID Monitor registration process and become a member of ID Monitor Service.

Privacy:

We respect your privacy.  Please click on privacy policy on the home page of this website to review .YOU agree to accept the terms of the Privacy Policy.

Changes to the Agreement:

We may change the terms of this Agreement at any time by notifying YOU of the change electronically on this website. The changes will appear in this document, which YOU can access at any time by selecting Terms of Use page on our website. Your use of ID Monitor after changes are made to this Agreement means that YOU agree to be bound by such changes.

Service use:

YOU agree that YOU will use ID Monitor Service only for your own behalf. YOU will be responsible for all use of your membership login and must notify us immediately of any unauthorized use of your membership. YOU agree not to use onlineguards.com and its ID Monitor service for any unlawful purpose. We reserve the right to terminate or restrict your access to onlineguards.com if, in our opinion, your use of onlineguards.com may violate any laws, infringe upon another person's rights or violate the terms of this agreement.

Membership Fees:

For the use of ID Monitor, YOU agree to pay the membership fees, transaction fees, or any other charges incurred in connection with your user account with onlineguards.com at the rates in effect when the charges were incurred. We will bill all charges automatically to your credit card or your paypal account. All fees will be billed at the beginning of your membership and beginning of the renewal period. Fees and charges are nonrefundable once YOU signup with Online guards. We may change the fees and charges then in effect, or add new fees or charges, by giving YOU notice in advance.

Renewal:

Your membership will renew automatically, at the same term and rate, unless we terminate it or YOU notify us by email of your decision to terminate your membership. YOU must cancel your membership before it renews in order to avoid billing of Membership Fees for the renewal term to your credit card or paypal account. YOU can email us at members [at] onlineguards.com to cancel your membership.

Description of ID Monitor Service:

Online guards will return any Financial and Personal Information of our Members when ever possible and if we identify that their personal or financial information is compromised or being misused.

Financial Information could be any of the following: Credit card number, ATM card number, Expiry date, CVV2 code number, PIN number, Bank account number, Bank routing number, Online Banking Login Username and Password, e-commerce logins like Paypal, eBay, Amazon or trading accounts.

Personal Information could be any of the following: First name, Last name, Address, Phone number, Email address, Passwords, Date of Birth, Drivers License, Social security number, Mothers Maiden Name.

Online guards makes no guarantees, warranties, or assurances that it will definitely find any of the members Financial and Personal Information, ONLY THAT IF IT DOES, it will notify the members through email or phone and all recovered information will be immediately returned to the member to take necessary action.

ID Monitor is a service provided by Online guards. The ID Monitor service may be modified or improved at any time and without prior notice. ID Monitor is a service mark of Online guards.

Trademarks, Copyrights and Restrictions:

Online guards, the logo and ID Monitor are registered trademarks or service marks of Panasa Web Solutions Private Limited.  YOU may not reproduce, perform, create derivative works from, republish, upload, post, transmit, or distribute in any way whatsoever any Online guards information without the express, written consent of Panasa Web Solutions Pvt. Ltd.

Governing Law:

This agreement and any sales hereunder will be governed by the laws of the state of Andhra Pradesh, INDIA, without regard to conflicts of laws. YOU irrevocably and unconditionally consent to submit to the exclusive jurisdiction of the state of Andhra Pradesh, INDIA for any dispute or litigation arising out of, or relating to, the use or purchase of any Service or Product made through Online guards, and waive any objection to the laying of venue of any such litigation in Hyderabad courts and agree not to plead or claim that such litigation brought therein has been brought in any inconvenient forum.

LIMITATION OF LIABILITY:

YOU UNDERSTAND AND AGREE THAT ONLINE GUARDS AND ITS DIRECTORS,  EMPLOYEES, AFFILIATES, SHAREHOLDERS, SUBSIDIARIES,  AND LICENSORS ("THE ONLINEGUARDS.COM PARTIES") WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES RESULTING FROM OR IN ANY WAY CONNECTED TO YOUR ACCESS TO, USE, OR INABILITY TO USE THE WEB SITE, SOFTWARE, SERVICES, MEMBERSHIP BENEFITS OR CONTENT, OR FROM YOUR ACCESS TO, USE, INABILITY TO USE, OR RELIANCE UPON ANY LINKED WEB SITE, REGARDLESS OF THE TYPE OF CLAIM, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHER LEGAL OR EQUITABLE THEORY, WHETHER OR NOT FORESEEABLE AND REGARDLESS OF THE CAUSE OF SUCH DAMAGES EVEN IF ONLINE GUARDS WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES
IN ADVANCE. SOME JURISDICTIONS EITHER DO NOT ALLOW OR PLACE RESTRICTIONS UPON THE EXCLUSION OR LIMITATION OF DAMAGES IN CERTAIN TYPES OF AGREEMENTS; FOR THESE JURISDICTIONS, THE AFOREMENTIONED LIMITATION ON LIABILITY SHALL BE TO THE MAXIMUM DEGREE PERMITTED BY APPLICABLE LAW. IF, NOT WITHSTANDING THE ABOVE, LIABILITY IS IMPOSED UPON ONLINE GUARDS, THEN YOU AGREE THAT ONLINE GUARDS'S TOTAL LIABILITY FOR ANY OR ALL YOUR LOSSES OR INJURIES FROM ONLINE GUARDS'S ACTS OR OMISSIONS, REGARDLESS OF THE NATURE OF THE LEGAL OR EQUITABLE CLAIM, SHALL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS OR THE AMOUNT PAID BY YOU TO ONLINE GUARDS UNDER THIS AGREEMENT.

Cancel Membership:

YOU have the right to cancel this agreement at any time. YOU may cancel this agreement by sending an email to us at members [at] onlineguards.com. This agreement shall be terminated and all ID Monitor benefits, including your member’s login, shall be cancelled if Online guards determine it is unable to bill your account successfully.

Electronic Agreement:

YOU AND ONLINE GUARDS HAVE ENTERED INTO THIS AGREEMENT INTENDING TO BE BOUND BY YOUR ELECTRONIC ACCEPTANCE OF THE AGREEMENT.  IN THE FUTURE, YOU AGREE TO BE BOUND TO SPECIFIC TERMS AND CONDITIONS OF SALES, AND MODIFICATIONS TO THIS AGREEMENT BY ELECTRONICALLY ACCEPTING SUCH TERMS AND
CONDITIONS.THIS AGREEMENT MAY BE PRINTED AND RETAINED BY YOU FOR FUTURE REFERENCE. YOU MAY WITHDRAW YOUR ACCEPTANCE OF THIS AGREEMENT AT ANY TIME PRIOR TO PURCHASING THE SERVICES BY NOTIFYING ONLINE GUARDS BY SENDING EMAIL,HOWEVER, YOU WILL NOT BE ABLE TO PURCHASE THE SERVICES. 

Acknowledgment:

The Terms of Use, including all documents referred herein, represents the entire understanding between YOU and Online guards regarding your relationship with Online guards and supersedes any prior statements or representations.  When using or purchasing Online guards services, YOU agree to be bound by these Terms of Use.
